Terms of Service

1. Who We Are

SafePhoto.ai is operated by ZeroFriction Labs LLC ("SafePhoto," "we," "us," or "our"). For questions about these terms, contact support@safephoto.ai.

2. Acceptance

By accessing or using SafePhoto.ai, you agree to these Terms. If you do not agree, do not use the service. You must be at least 18 years old (or have verifiable guardian consent).

3. Our Service

SafePhoto provides AI-powered headshot generation. The service is provided “as available” and results may vary. We may update, pause, or discontinue features at any time.

4. Accounts & Security

You are responsible for your account credentials and for keeping your information accurate. Notify us promptly of unauthorized use.

5. Payments, Taxes, and Refunds

• Prices shown include VAT and sales taxes where applicable.
• Charges occur when you place an order.
• Refunds are evaluated case by case, primarily based on the quality and suitability of images you uploaded and the resulting outputs. If outputs are unusable despite compliant uploads, contact support within 7 days; we may rerun, replace, or refund at our discretion.

6. Content and Licenses

• Your uploads: You retain ownership. You grant SafePhoto a limited license to host, process, and generate outputs solely for your order, and to store them temporarily for delivery and support.
• Outputs: We grant you a personal, non-transferable license to use your generated images.
• No reuse for others: We do not use your uploads or outputs to train models for other customers.
• You must have all rights to the images you upload and must not infringe others’ rights.

7. Prohibited Use

Do not upload or generate: illegal content; CSAM; hateful or violent content; explicit nudity; IP-infringing material; deceptive “deepfakes” for fraud; or images of minors without lawful authority. Do not abuse, scrape, reverse engineer, circumvent limits, or interfere with the service.

8. Data Retention & Deletion

We retain uploads/outputs only as long as needed to deliver your order and provide support, after which they are deleted on a rolling basis. You may request deletion of your data at support@safephoto.ai.

9. AI Safety and Disclaimers

Outputs may contain artifacts or inaccuracies. Do not rely on them for identity verification, medical, legal, or biometric purposes. Review outputs before use.

10. Third-Party Services

Payments are processed by Stripe/Paystack. Model inference may use third-party providers (e.g., Fal, Google Gemini). Your use may be subject to their terms and privacy policies.

11. Intellectual Property

SafePhoto.ai site content, trademarks, and branding belong to SafePhoto. You may not use them without permission. You grant us a free, perpetual license to use any feedback you provide.

12. Warranties & Limitation of Liability

The service is provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, we disclaim all warranties and limit liability to the amount you paid for the service in the 12 months before the claim. Some jurisdictions do not allow certain limitations; those limits apply only to the extent permitted.

13. Indemnity

You agree to indemnify and hold SafePhoto harmless from claims arising out of your uploads, outputs, or misuse of the service.

14. Termination

We may suspend or terminate accounts for violations. Termination does not waive any owed fees.

15. Governing Law & Disputes

These Terms are governed by the laws of the State of Maryland, USA (without conflict rules). Courts in Maryland shall have exclusive jurisdiction unless otherwise required by law.

16. Changes to Terms

We may update these Terms; material changes will be posted on this page. Continued use after updates constitutes acceptance.
